详解：聘请海外海产农工LMIA申请流程 （Shellfish Farm Worker LMIA Application Process）
加拿大海外农工项目分为很多类别：
海外农工的分类 Hire a temporary foreign agricultural worker
You can hire a temporary foreign agricultural worker under one of the following streams:
- 季节性农工项目 Seasonal Agricultural Worker Program
- 只能聘用 墨西哥、地中海加勒比地区国家的工人 temporary foreign worker must be from Mexico or the participating Caribbean countries
- 必须是国家农产品清单上的产品 production must be included on the National Commodities List
- 普通农工 Agricultural stream
- 可以来自任何国家 temporary foreign worker can be from any country
- 必须是国家农产品清单上的产品 production must be included on the National Commodities List
- 高薪岗位 Stream for high-wage positions
- 不是国家农产品清单上的产品 production is not included on the National Commodities List
- 任何高薪岗位 temporary foreign worker can be hired for any high-wage agricultural position
- 低薪岗位 Stream for low-wage positions
- 不是国家农产品清单上的产品 production is not included on the National Commodities List
- 任何低薪岗位 temporary foreign worker can be hired for a low-wage agricultural position
国家农产品清单National commodity list：
- 蜂产品apiary products
- 水果，蔬菜（如果在农场种植，则包括罐头/加工这些产品）fruits, vegetables (including canning/processing of these products if grown on the farm)
- 蘑菇mushrooms
- 花卉flowers
- 苗圃树木，包括圣诞树，温室/苗圃nursery-grown trees including Christmas trees, greenhouses/nurseries
- 纯种油菜籽pedigreed canola seed
- 玉米种子seed corn
- 谷物grains
- 油种子oil seeds
- 枫糖浆maple syrup
- 草皮sod
- 烟草tobacco
- 牛bovine
- 乳业dairy
- 鸭duck
- 马horse
- 貂mink
- 家禽poultry

由于贝类海产 （Shellfish）不属于 国家基本农产品名录 （national commodities list）上的商品，因此农场主必须走低薪岗位海外劳工（low wage stream）LMIA申请。
薪资水平 Wages
海外劳工的薪资必须按照本地加拿大公民或PR的薪资水平 同工同酬 发放。Wages offered to temporary foreign workers should be similar to wages paid to Canadian and permanent resident employees hired for the same job and work location, and with similar skills and years of experience.
雇主必须支付海外劳工当地行业内流行薪资，或政府发布的行业中位数薪资。 For the purpose of the Temporary Foreign Worker Program, you must pay the prevailing wage which is defined as the highest of either:
- 参考 政府JobBank网站 查询中位数薪资信息 。 the median wage on Job Bank
- 在地员工同级技能的工资水平。 the wage that is within the wage range that you are paying your current employees hired for the same job and work location, and with the same skills and years of experience
雇主须选二者中薪资数值高位者为海外农工的实际薪资标准。

定位薪资职位类别 If you are offering a wage to a temporary foreign worker that is:
- 达到或高于以上省内时薪是高薪职位。at or above the provincial or territorial median hourly wage, you must apply under the Stream for high-wage positions
- 低于以上省内时薪是低薪职位。 below the provincial or territorial median hourly wage, you must apply under the Stream for low-wage positions
企业的低薪海外劳工申请人数上限 Cap on proportion of low-wage positions
如果海外劳工的薪资低于加拿大相关省的中位数时薪，则属于低薪劳工。在一家公司内，低薪海外劳工的人数是有上限的。If you are hiring temporary foreign workers and offering them a wage that is below the provincial or territorial median hourly wage, you are subject to a cap on the proportion of temporary foreign workers that you, as an employer, can hire in low-wage positions at a specific work location.
通常，一家企业可以雇佣海外劳工的上限是10%。10% cap on the number of temporary foreign workers in low-wage positions if the employers did not employ a temporary foreign worker in a low-wage position prior to June 20, 2014。
免除海外劳工上限的例外情形 Exemptions to the cap：
- 如果整个企业在全国内的职员工少于10人 （含待申请LMIA的海外劳工）可以免除上限规定。 low-wage positions, if your business has fewer than 10 employees nationally, including the vacant positions you are applying to staff with temporary foreign workers

申请流程
对雇主和企业的要求：
满足下列两个条件的雇主可以简化公司的证明文件：
- 该雇主/企业在过去两年内成功办理过LMIA
- 而且最近一次申请是正向的LMIA（positive）
公司财务状况的证明：
如果公司在两年内成功申请过LMIA，以及最近一次的LMIA的结果是积极的，下列文件可以不必提交。如果不是，则需要至少提交一份证明。
- 资产负债表和利润表/损益表（T2 Schedule 100 Balance sheet information and T2 Schedule 125 Income statement information）
- 农场主报税表（T2042 Statement of farming activities）
- 公司或专业人士纳税表（T2125 Statement of business or professional activities）
- 慈善机构纳税表（T3010 Registered charity information return）
- 公司支付劳工薪水记录/工资条，在LMIA提交前至少6周（T4 or payroll records for a minimum of 6 weeks immediately prior to the submission of this LMIA application, pay periods if the temporary foreign worker already works for you）
- 律师/会计师关于公司财务状况的解释信（an attestation confirming that your business is in good financial standing and will be able to meet all financial obligations to any temporary foreign worker you hire for the entire duration of their employment）
注：如果提交CRA相关文件，必须是最新和最近的。
公司正常运转的证明：
如果公司在两年内成功申请过LMIA，以及最近一次的LMIA的结果是积极的，下列文件可以不必提交。如果不是，则需要至少提交一份证明。
- 营业执照（municipal/provincial/territorial business license）
- 公司支付劳工薪水记录（T4 Summary of remuneration paid）
- CPB, EI支付清单（PD7A Statement of account for current source deductions）
- 律师/会计师关于公司运营情况的解释信。如果要申请PR，则公司需至少运营1年（an attestation confirming that you are engaged in a legal business that provides a good or a service in Canada where an employee could work and a description of the main business activity. Permanent residency stream only, confirmation that the business has been operating for at least one year must also be included in the attestation）
注：如果提交CRA相关文件，必须是最新和最近的。
申请LMIA第一步：打招聘广告
申请LMIA 之前必须在三个不同媒体（如Job bank）上打至少一个月的广告。招聘广告必须需覆盖到不同的少数人群（Indigenous persons, vulnerable youth, newcomers, and persons with disabilities）。有的媒体收费，一般预算在$500-$1000。
Job bank上所有匹配度为2星以上的加拿大公民和移民身份的申请人均需要面试，登广告的记录和申请人面试记录都要备份，说明不被录取原因和保留简历，程序比较繁琐。
申请LMIA第二步：农工住房审核 Housing inspection
Employers in British Columbia must:
- 使用BC省农业委员会的表格提交申请 use the British Columbia Agriculture Council (BCAC) housing inspection form; and
- 农委会30天内会派人前来审查 have the housing inspection conducted by a BCAC sanctioned inspector, authorized to conduct housing inspections.
- Actual forms may be purchased by approved inspectors from the BCAC office (Abbotsford) or BCFGA office (Kelowna).
其他要求：
- 聘书（Job Offer），雇佣条件，雇佣合同（Employment Contract）
- 雇主给出的聘书需要遵守省劳工法的标准
- 要列明每周工作时长和加班时长
- 补贴/福利
- 工作环境
- 结束聘用的条件
- 劳工伤害保险等
- 刊登广告30天以后填写申请表，提交LMIA application。
申请LMIA第三步：提交低薪劳工LMIA申请
Under this Stream employers must complete, sign (where applicable) and submit the following documents:
- 每个申请人需支付$1,000的申请费。
- 低薪海外劳工LMIA申请表 LMIA Application form (EMP5627) （两种方式：指定申请人提交、或无指定申请人 Unnamed提交） ESDC-EMP5627
- 雇佣合同 Employment contract (EMP5510) ESDC-EMP5510
- 公司信息 Proof of business legitimacy
- 招聘信息 Proof of advertisement, applicable in most cases
- BC省海外劳工房屋审核报告 BC Housing inspection report
- 过去成功办下来LMIA的批准函拷贝（如适用）
申请LMIA第四步：LMIA批准以后，申请工签：
- 申请费是$155×1
- 雇主申请移民部海外劳工担保许可费、登记号 (未来可接受政府审核遵守相关劳工法的情况) Employer compliance fee、number $230×1
- 工签申请表
- 工作背景、教育背景
- 无犯罪记录证明
- 体检报告、指纹采集
一旦工签获得批准，雇主需支付海外劳工来加拿大的机票，食宿费。不得从工资里扣除。
