美国移民欺诈 之 政治庇护欺诈

在移民欺诈专题中,另一个脍炙人口的移民欺诈途径:政治庇护欺诈。很多华裔移民试图通过政治庇护解决身分问题,假如您在母国受到迫害申请美国政府庇护,这是理所当然,有法可依。但若误选无良代理律师、无知听信中介、或故意造假申请绿卡将会后患无穷。王律师早就在之前建议过大家不要随便申请政治庇护。希望大家不要听信无良律师和中介的劝说,或者一些没有经过证实的谣言,轻易走上政治庇护这条不归路。
在这里,也为大家总结了一些相关法律,看一看,政治庇护欺诈的严重后果:
1)永远不能够得到各种移民身份:
根据美国相关法律规定IINA 208(d)(6):”如果被美国司法部长判定,申请者在知情的情况下提交申请虚假政治庇护,该外籍申请人的签证都将会被拒绝。“
2)政治庇护欺诈也算犯罪
在美国相关法律的18 U.S.C. § 1546中提到:任何申请人在知情的情况下通过欺骗的方式获得移民类或非移民类签证,以得到合法身份在美国生活和工作,将会受到相应罚款或判最高有期徒刑25年(假如移民涉及国际恐怖袭击),20年(涉及毒品非法交易),10年(初犯涉及恐怖袭击和非法交易活动)以及15年(无论是否初犯,在任何情况下).
美国政治庇护申请的大体流程
如果您有真的政治庇护案件,那么这图表就解释了政治庇护申请的大体流程:
美国移民局通常会对欺诈的处理是相当严肃的。假如在移民局在审理的庇护案件中发现欺诈成分,会当即否决这个案子。申请者在移民审查行政办公室(EIOR)下达任何移民判决前就会被下达递解通知。然而,并不是所有被拒绝的政治庇护案都是因为欺诈。有些申请者的故事可能是真的,但是移民官员就是没有批准。有些申请者的故事大体都是真实的,也许参合了某些夸大的成分,移民官就会怀疑整个故事的真实性。假如政治庇护申请者的案子遭到否决,但是这位申请者仍旧以其他类别签证,比如学生签证来回美国,移民及海关执法局(ICE)发现后也会追究到底,涉及欺诈成分也会有被递解出境的风险。如果帮助申请政治庇护的代理律师东窗事发,即便已经顺利拿到绿卡的政治庇护案子也会重新追查,诈骗证据确凿的话不仅绿卡会被吊销,持有人也将会被驱逐出境、永远不能返回美国。
如果案件被转至移民法庭,而你也无法说服移民法官,你将会背负递解令,错失得到绿卡的机会。那么被下发递解令和被ICE逮捕后,被强制驱除出境是唯一的结局吗?还有机会拿到合法身份留在美国吗?拿到递解令的朋友不必太过绝望,因为在拿到递解令的30天内是可以向美国移民上诉委员会(BIA)进行上诉的,这表示您对裁决的结果感到不满意,如果对裁决结果一直不满意,可在收到判决书后一直上诉。如果您错过了30天的期限,也可以在90天内找律师为您翻案。通常移民法庭都会有信件通知您,但是很多我们接手过的客人,因为不懂英语也不知道自己有上诉的权利,白白错过了上诉和翻案的最佳时机(只有在非常特殊的情况下,超过90天还可以翻案)。所以一旦受到来自移民局和法庭的信件后,应当及时咨询专业的移民律师,不仅仅只是为了帮您翻译信件上的内容,也是为了告诉您,这条漫长的身份申请道路接下来该怎么走。
