Over the past few months, many changes have been made to how various groups can conduct business with Citizenship and Immigration Canada (CIC). This Interpretation Bulletin has been created to explain clearly what these new rules mean to Employees of Authorised Representatives.

How does Bill C-35 affect Employees of Authorised Representatives:

C-35法案将任何非经加拿大移民部授权的任何人，若提供有偿的移民咨询服务 视为犯罪。 经加拿大移民部授权的代理为：ICCRC 持牌移民顾问（ Regulated Canadian Immigration Consultants – RCICs ）， 加拿大省或地区的持牌律师，魁省认可的公证员。 ICCRC 持牌移民顾问可在ICCRC网站上搜寻验证。

Bill C-35 made it an offence for anyone other than an Authorized Representative to offer immigration services for a fee. Authorized Representatives include: members in good standing of ICCRC (known as Regulated Canadian Immigration Consultants – RCICs), lawyers in good standing with a provincial or territorial law society and notaries who are members in good standing of the Chambre des notaires du Québec. What are the penalties?

被法庭指控定罪（省法庭/联邦法庭/高等法院/陪审团），根据C-35法案，加倍判罚 从50000加元到100000加元和/或有期徒刑2年。若被简易审判程序定罪 （省法庭/无陪审团机制），根据C-35法案，加倍处罚从10000加元到20000加元和/或监禁六个月。

Bill C-35 doubled the penalties from $50,000 to $100,000 and/or imprisonment of up to 2 years for conviction by indictment. Bill C-35 doubled the penalties from $10,000 to $20,000 and/or imprisonment for up to six months on summary conviction.

无授权移民代理时, 合法移民代理的雇员可以做什么？
What Employees of Authorized Representatives may do without being an Authorized Representative:

在合法移民代理的监督和IMM5476表提交的情况下，雇员可以准备文案/代表移民顾问和加拿大签证办事处通信。合法的移民顾问对雇员的行为负有全责。

If directly supervised by the Authorized Representative and an IMM5476 form is submitted, they may prepare documentation and correspondence on behalf of the Authorized Representative and send to the CIC processing office. The supervising Authorized Representative is responsible for the employee’s actions and conduct.

合法移民代理的雇员严禁做什么？
What Employees of Authorized Representatives may not do unless they are an Authorized Representative:

无权代理客户上诉出庭。如无合法移民顾问的监督，不得起草文案/和书信。

They may not represent clients at CIC/CBSA hearings or proceedings, and they may not prepare documentation or correspondence for a client without the supervision of an Authorized Representative
